Registrar's Circular No. 3 of 2026

It was agreed at the 12th Council of ASEAN Chief Justices Meeting on 15 November 2025 that the Model Framework for Communication and Cooperation between ASEAN Courts in Cross-Border Insolvency Proceedings (the Model Framework, a copy of which is enclosed in Schedule I herein), be approved and that the ASEAN judiciaries consider adopting the Model Framework subject to and in accordance with the respective ASEAN Member State’s laws, regulations and legal framework and with such modification as each ASEAN judiciary deems fit. The Model Framework seeks to facilitate communication and cooperation in proceedings relating to insolvency, or adjustment of debt for the purposes of reorganisation or liquidation, of corporations which are opened in more than one ASEAN Member State (the Cross-Border Insolvency Proceedings”).

2. Pursuant to paragraph 6 of the Model Framework, the Supreme Court appoints the Registrar as the point of liaison and, in the Registrar’s absence, the Deputy Registrar as the alternative point of liaison. The Supreme Court may communicate and coordinate directly with the relevant court in an ASEAN Member State that has adopted the Model Framework for the purposes set out in the Model Framework.

3. The above complements the Guidelines for Communication and Cooperation between Courts in Cross-Border Insolvency Matters (the “JIN Guidelines”) and the Modalities of Court-to-Court Communication (the “JIN Modalities”), both published by the Judicial Insolvency Network (“JIN”) and adopted by the Supreme Court under Registrar’s Circular No. 1 of 2017 and Registrar’s Circular No. 7 of 2020, respectively. Parties may have regard to the JIN Guidelines, JIN Modalities and/or the Model Framework, as may be appropriate, to facilitate the coordination and administration of Cross-Border Insolvency Proceedings in suitable cases.
