Amendment No. 1 of 2020

The amendments revise the pre-action protocol for business-to-business debt claims. With effect from 20 April 2020, the State Courts Practice Directions will be amended —

1. by deleting the existing Practice Direction 144 (Pre-action Protocol for Business-to-Business Debt Claims) and replacing it with the following Practice Direction:
   New Practice Direction 144
2. by deleting the existing Appendix L (Pre-Action Protocol for Business-to-Business Debt Claims) (the “Protocol”) and replacing it with the following Appendix:
   New Appendix L

Pursuant to the amended Practice Direction 144(2) the amended Protocol will apply to actions that are commenced in the State Courts from 4 May 2020 onwards. The previous Protocol shall continue to apply for actions commenced prior to 4 May 2020.

The Protocol will be reviewed in November 2020. A Registrar’s Circular or another amendment to the State Courts Practice Directions may be issued after the review if any further amendments to the Protocol are required.
