Covid-19 Advisory: Filings under the COVID-19 (Temporary Measures) regulations in the Supreme Court

Filings under the COVID-19 (Temporary Measures) (Temporary Relief for Inability to Perform Contracts) Regulations 2020

Parties who seek relief under Sections 5(8) or 8(2) of the COVID-19 (Temporary Measures) Act 2020 (C19TMA) in respect of any proceedings in court are required to file the Memorandum of Notification for Relief as provided under Regulations 9(4) or 9(5) of the COVID-19 (Temporary Measures) (Temporary Relief for Inability to Perform Contracts) Regulations 2020 (C19TMRegs). Filings must be made in the eLitigation case file of the court proceedings, under the document title Other Hearing Related Requests. Similarly, a party who wishes to file any other form prescribed under the C19TMRegs is required to file that form in the eLitigation case file of the court proceedings, under the document title Other Hearing Related Requests.

If you are represented, your lawyer may file the Memorandum of Notification for Relief and other prescribed forms under the C19TMRegs on your behalf. If you are unrepresented, you may file those documents at the LawNet & CrimsonLogic Service Bureau.

Filings under the COVID-19 (Temporary Measures) (Part 8 Relief) Regulations 2020

Parties who apply for the appointment of an assessor under Part 8 of the C19TMA, and are aware of the court proceedings taken out in breach of the moratorium under Section 37A(1) of the C19TMA, are required to file the Memorandum of Application for Determination under Part 8 as provided under Regulation 8(3) of the COVID-19 (Temporary Measures) (Part 8 Relief) Regulations 2020 (C19TMP8Regs). Filings must be made in the eLitigation case file of the court proceedings, under the document title Other Hearing Related Requests. Similarly, a party who wishes to file any other form prescribed under the C19TMP8Regs is required to file that form in the eLitigation case file of the court proceedings, under the document title Other Hearing Related Requests.

Filings under the COVID-19 (Temporary Measures) (Part 10 Relief) Regulations 2021

Parties who seek relief under Sections 43(1) or 43(5) of the C19TMA are required to file with the court a Memorandum of Notice of Negotiation or Notice of Revision in the circumstances described in Regulations 11 and 19 of the COVID-19 (Temporary Measures) (Part 10 Relief) Regulations 2021 (C19TMP10Regs). Such Memoranda must be filed in the eLitigation case file of the relevant court proceedings, under the document title Other Hearing Related Requests. Similarly, a party who wishes to file any other form prescribed under the C19TMP10Regs is required to file that form in the eLitigation case file of the court proceedings, under the document title Other Hearing Related Requests.
