Applicable Family Justice Rules 

The set of Family Justice Rules 2024 is collectively referred to as the FJR 2024. The FJR 2024 comprises:

a.   Family Justice (General) Rules 2024.
b.   Family Justice (Probate and Other Matters) Rules 2024. 
c.   Family Justice (Protection from Harassment) Rules 2024.
d.   Family Justice (Criminal Proceedings in Youth Courts) Rules 2024.

The Family Justice Rules (as in force immediately before 15 October 2024) are referred to as the FJR 2014.

Application of the FJR 2024

Unless otherwise provided in Part 1 Rule 2 of the Family Justice (General) Rules 2024 and Part 1 Rule 2 of the Family Justice (Probate and Other Matters) Rules 2024, the FJR 2024 will generally apply to:

  • All proceedings in the Family Justice Courts which are commenced on or after 15 October 2024, including appeals arising from those proceedings.

Refer to Part 1 Rule 2 of the Family Justice (General) Rules 2024 and Part 1 Rule 2 of the Family Justice (Probate and Other Matters) Rules 2024 for details on the applicability of the FJR 2024.

Application of the FJR 2014 

Under Part 1 Rule 2(1) of the Family Justice (General) Rules 2024, the FJR 2014 are revoked with effect from 15 October 2024. However, the FJR 2014 will continue to apply in the circumstances highlighted below:

  • Any proceedings commenced in the Family Justice Courts before 15 October 2024.
  • Any application for an order for financial relief under section 121B of the Women’s Charter 1961 made on or after 15 October 2024, where the leave of the court under section 121D of that Act to make the application was granted before 15 October 2024.
  • Any appeal heard by the Family Division of the High Court arising from any of the above proceedings.
